Greenhouse gases, including methane and carbon dioxide, are currently federally-regulated air pollutants. New or
modified sources of greenhouse gases may be required to obtain permits and to implement controls to reduce greenhouse
gas emissions. In 2015, the EPA promulgated the Clean Power Plan to reduce carbon dioxide emissions from existing
fossil fuel-fired electric generating units. However, in October 2017, the EPA... ...EPA proposed the Affordable Clean Energy rule (ACE) rule, as a replacement rule to reduce
greenhouse gas emissions from coal-fired power plants. The EPA has not yet finalized the repeal of the CPP or approved
the ACE rule.
In June 2016, the EPA... ...EPA acted arbitrarily and capriciously, and in excess of statutory authority. These cases have
been consolidated and are pending before the court (West Virginia v. EPA, 16-1264). In July 2017, the court held that the
rule must be implemented while the EPA considers alternatives. In October 2018, the EPA proposed revisions to the New
Source Performance Standards for the oil and gas industry that would change requirements for leak detection and repair.
