"Did Germany engage in this negotiation with intent to lose, or “lose,” it? The Loon cannot tell with the information she has. She can envision the playbook, though, and she does believe Germany thought through this branch of the possibilities: Elsevier does not offer an acceptable deal because it never does, and Elsevier does not anticipate Germany saying no because no one says no to Elsevier, so Germany can negotiate in all good faith believing it will “lose” and planning for that. Rather than concentrating wholly on the negotiation, then, Germany places bets on the crucial blame-the-vendor PR game. If that is successful, no matter what Elsevier does, Elsevier loses."
