The association of Belgian publishers will study with lawyers and advisers the text of the decree, once it is published. "It does not say that it is constitutionally correct," notes Bernard Gerard. "This decree confiscates its right of ownership to the author and the right of exploitation by the publisher. There may be something on this side to review. He notes that some countries like France have chosen to reward the work of the publisher upstream.

ADEB would also have appreciated having longer embargo periods. They are six months for pure sciences and 12 months for human sciences. The publishers proposed respectively 18 and 24 months."
