The importance of the civil action cover sheet

A recent superior court decision has underlined the importance of a full and accurate reporting of the injuries on the Civil Action Cover Sheet. The form requires a listing of expenses as well as a description of the injury, including the nature and extent. In Stankiewicz v. DiStefano, Judge Curran admonished counsel to comply with Superior Court rule 29. The case was dismissed since the cover sheet did not include a detailed listing of injuries that were caused by the defendant. Plaintiffs must meet the burden of showing that they have a reasonable likelihood of recovery of over $25,000 to proceed in Superior Court.
