General Song Similarity Enough in the 4th

Copyfight 2015-07-01

Summary:

Justin Bieber and Usher lost a round in their defense of the originality of songs titled "Somebody to Love.". The Fourth Circuit affirmed that the correct standard to use was "total concept and feel" (go ahead, define THAT one) and then ruled that on those grounds a jury might find the defendants' songs similar enough to a song by Devin Copeland. The case now goes back down to the district level for a trial, since the previous action by Judge Allen was a summary decision, now vacated.
