Title II and Research Libraries: Community Call

ARL Policy Notes 2024-08-13

On April 24, 2024, the Federal Register published the US Department of Justice’s final rule on Title II of the Americans with Disabilities Act (ADA), which includes specific rules for state and local governments to ensure that web content and mobile applications are accessible to people with disabilities. Most entities have until April 24, 2026 to comply with this regulation (smaller public entities have until April 26, 2027).

Join ARL and experts from the research library and disability rights community for a discussion about how libraries are preparing to implement the updated regulations. After an overview of the regulations we will dig into two aspects of the new rules: the archived web content definition, and the implications for licensed content. This call is for anyone who is working on accessibility at an ARL member institution. Please bring your questions!

Overview of regulations, exceptions, and limitations (15 min)

  • Nancy Horton, ADA network

Analyzing the archived web content definition (20 min)

  • Claire Stanley, Director of Advocacy and Government Affairs, American Council of the Blind, will review the four elements of the “archived web content” definition, and offer insight into how the definition can be interpreted.
  • Discussant: Hana Levy, Collection Assessment Librarian, UW, will share examples of scenarios in which libraries may have to apply their own analysis of the archived web content exception.

Leveraging regulations in vendor negotiations (20 min)

  • Samantha Teremi, UC Berkeley Library will share their successful strategies in negotiating for accessible content with scholarly vendors. Institutions are legally responsible for complying with Title II regulations, even for licensed content; Teremi will discuss how research libraries can leverage this obligation in their own negotiations to provide scholarly content in accessible formats.
