Member Session: Hachette v. Internet Archive (Invitation Only)
ARL Policy Notes 2024-01-18
On Friday, February 2, 2024, Brandon Butler (University of Virginia Library), Peter Jaszi (Washington College of Law, American University), and Jonathan Band (policybandwith) will join an ARL member session about the amicus brief for Hachette v. Internet Archive in support of neither party. The brief argues that the district court ignored binding precedent, misread the statute, and misapplied other cases in finding the Internet Archive’s use to be “commercial.” The brief further argues that libraries and library users are crucial to the copyright ecosystem and the Court’s decision in this case should preserve their fair use rights.
Brandon Butler’s and Peter Jaszi’s firm, Jaszi Butler, provides fair use counsel in the academic arena, public policy, and in private practice. More information can be found on their website: https://www.usefairuse.com/about.
Jonathan Band helps shape the laws governing intellectual property and the Internet through a combination of legislative and appellate advocacy. Read more about his work at: https://www.policybandwidth.com/.
