Instead of drastic changes to Section 230, one option the agency might study is a modest claw-back of the large platforms’ immunity—by making them liable for knowingly promoting unlawful content or activity that threaten or intentionally incite physical violence (or conspiracies to do violence), that clearly constitute online harassment, or that constitute commercial fraud. These large platforms might earn a safe harbor by developing detailed, transparent, appealable practices specifically for disrupting coordinated campaigns that conduct such unlawful acts. In the case of white supremacy, this new approach would likely hamper the ability of Gab and 8chan—the websites that allow the networks of white supremacists to organize—to remain online.
