Barriers and Enablers for Open Science in Copyright Law – Knowledge Rights 21

peter.suber's bookmarks 2025-06-03

Summary:

"Accordingly, this study pinpoints legal barriers to Open Science within the copyright law provisions of national legal systems that need to be amended in the future. It also identifies provisions that serve as enablers for Open Science and should therefore be maintained or strengthened.

The study analyses three different jurisdictions, in order to reflect the fact that national copyright laws are not fully harmonised. Firstly, it analyses the provisions in the Slovenian Copyright and Related Rights Act (Slo. Zakon o avtorski in sorodnih pravicah, hereinafter: ZASP). It then looks at two neighbouring jurisdictions, namely Italy and Croatia."
