Why open access does not need CC-BY: Human Genome Project example

The Open Access Scholarly Publishers Association's "Why CC-BY" page points to the Human Genome Project as an example of why CC-BY is needed. The trouble with this example is that HGP was concluded shortly after the birth of Creative Commons. This is a great counter-example - why CC-BY is NOT needed for libre open access at all.
