[Orin Kerr] Happy 30th birthday to the CFAA

Summary:

The Computer Fraud and Abuse Act will celebrate its 30th birthday in two weeks, and Future Tense and New America’s Open Technology Institute joined together to host a panel on how the statute is faring. I was on the panel, which was moderated by Robyn Greene. My co-panelists were Josephine Wolff and Justin Peters.

You can watch the event here, starting around the 17-minute mark. I offer my first set of comments around the 33-minute mark. Big picture topics covered include whether the CFAA is needed and how courts should interpret it. We also talked a lot about specific cases, including Facebook v. Vachani, the Aaron Swartz prosecution and United States v. Auernheimer.
